Mishima agreed to fund nearly $50,000 in payments as part of a settlement to resolve claims its peas don’t actually contain wasabi — and class members do not need proof of purchase to make a claim.
The settlement benefits consumers who purchased Mishima Wasabi Green Peas in California between April 6, 2016, and March 17, 2022.
Mishima sells wasabi roasted hot green peas in small packages at grocery stores and other retailers. According to listings of the product, these wasabi peas are flavored with wasabi powder — a combination of starch, wasabi oil, and food coloring.
According to a class action lawsuit against Mishima, these peas are sold using false advertising.
Although the wasabi power gives the peas a wasabi flavor, consumers say they were misled by the product’s marketing. The product packaging allegedly fails to disclose the peas are flavored instead of containing real wasabi. As a result, consumers contend that they were misled into believing that the products contained real wasabi.
Other companies have faced similar allegations over their wasabi products.
In November 2021, 7-Eleven was hit with a class action lawsuit challenging its own wasabi-flavored snack mix touting wasabi peanuts and wasabi green peas. Like Mishima, 7-Eleven is accused of false advertising.
Mishima hasn’t admitted any wrongdoing but agreed to pay nearly $50,000 to resolve these allegations.
Under the terms of the Mishima settlement, class members can collect product vouchers or cash payments. The amount each class member can collect depends on the number of qualified purchases they made and whether they provide proof of purchase.
Class members who provide proof of purchase can receive either $1 or one product voucher for each qualified purchase of Mishima wasabi peas.
Without proof of purchase, class members are limited to a maximum of $5 or five product vouchers.
Only one claimant is allowed per household.
The deadline for exclusion is July 31, 2022. Class members can exclude themselves from the settlement using the online exclusion form on the settlement website.
The final approval hearing for the settlement is scheduled for July 26, 2022. Class members do not have to attend this hearing.
In order to receive benefits from the settlement, class members must submit a valid claim form by Aug. 2, 2022.
